Loreley Pereyra Pollak, a 59-year-old resident at Holiday Villas condominiums
in Staten Island, New York recently won $4 million from the condominium
development’s managing agent and its contractor. While that may
seem like a large amount, it was hardly inappropriate considering the
severe back injuries Mrs. Pollak that have left her permanently disabled
even after major surgery.
Mrs. Pollak was leaving her condo one evening when she
slipped and fell on her front steps due to a fatal combination of accumulated snow and
slippery sheet ice. A forensic meteorologist testified on the icy conditions
of Mrs. Pollak’s patio, and her attorney pointed out that the bylaws
of the condominium held the homeowner’s association responsible
for clearing snow and ice up to the front doors of the condos. Mrs. Pollak
will be unable to walk, stand, or even sit for long periods of time for
the rest of her life because a contractor hired by the homeowner’s
association failed to do his job.
The Staten Island jury easily found the condominium 75 percent negligent
(and the contractor 25 percent negligent). The court awarded Mrs. Pollak
almost $4.1 million in damages, which includes about $2.6 million in damages
awarded for “pain and suffering” – a pretty high amount
for the normally conservative court, but then again, Mrs. Pollak will
be in constant pain for the rest of her life. Even after undergoing surgery
after having sustained
several spinal fractures from the fall, Mrs. Pollak has basically been left with a broken back.
Multimillion dollar recovery or not, Mrs. Pollak’s situation is truly
tragic. However, it is heartening to see that the parties responsible
for her life-altering injuries have been held responsible before the law
and that Mrs. Pollak was given the justice and compensation she deserved.
