Penalties for Multiple DWI in Texas
Law enforcement and the criminal justice system makes the erroneous assumption
that steeper penalties will curb people’s behaviors. Instead, it
only brings them undue hardship in their day-to-day lives. One of the
reasons we fight so hard for our clients is so that we can do our part
in keeping the penalties as minimal as possible, knowing that the default
sentencing is often in total excess of the alleged crime.
If you are convicted for a second DWI offense, the penalties can include:
- $4,000 fine
- 30 days to 1 year of jail time
- 2 year license suspension
- $2,000 a year surcharge for 3 years
If you are convicted for a third DWI offense, the penalties could be:
- $10,000 fine
- 2 to 10 years in prison
- Another 2 year license suspension
- Additional $2,000 yearly surcharge for 3 years
A DWI invention course may also be necessary, requiring more fees and time
taken out of your schedule. If an ignition interlock device (IID) is installed
in your car, you will also be taxed monthly for it.
