Whose Fault Was the Accident?
You are only entitled to compensation if the accident was the uninsured motorist's fault. For example, if you rear-end somebody else and he or she doesn't have insurance, you can't file a claim or sue for damages if your car was damaged in the accident. However, if someone else hits you or is otherwise at fault for the accident, you are entitled to compensation for the accident.
Sometimes it's difficult to determine who is at fault for an accident:
- In most states, insurance companies have the right to assign fault to both parties for the accident.
- If this happens, you are only entitled to a percentage of the compensation you would have received if the accident was totally the other person's fault.
- For example, if you are 75 percent at fault for the accident, you are entitled to 25 percent of the compensation you would get if the uninsured motorist was 100 percent responsible.
If you are involved in an accident where the other person has insurance but their insurance doesn't cover your damages and injuries, you have an underinsured motorist claim. You have to go through the same process of talking to your insurance company and to an attorney to determine how to get compensation for the portion of your claim that the other driver's insurance doesn't cover.
