Three Common Misdemeanor Offenses

Misdemeanors and felonies are the two major types of crimes defined by the United States federal criminal code. Misdemeanors are lesser offenses that are normally less severely punished than felonies. For the same general category of crime it is possible to be charged with either a misdemeanor or felony depending on the level of severity. For example for assault, if someone only threatens to harm a person without actually doing it then this would usually be classified as a misdemeanor; if however someone actually executes an assault, bodily harming someone, then a felony will be charged.

Here are three common types of misdemeanors.

Drunk and Disorderly

Drunk and disorderly, also know as public intoxication is a Class C misdemeanor (the least severe category of misdemeanor) in Texas. A charge for public intoxication usually results from causing disturbance while intoxicated (from alcohol or drugs) in a public or private environment.

Petty Theft

While other types of theft such as grand theft, larceny, and stealing can be charged as a felony, petty theft is generally classified as a misdemeanor. Depending on the state, for a theft to be classified as petty theft, it needs to be a theft of under a certain amount of money. In Texas, a theft up to $1,500 is still charged as a misdemeanor - though between $500 and $1,500 it is a Class A misdemeanor.

Criminal Trespass

Criminal Trespassing involves the unlawful entry of an individual upon private property. Ordinary criminal trespass is usually charged as a Class B misdemeanor according to Texas law. In certain more serious cases a criminal trespass offense can also be charged as a felony.
