This week Matt and Blair won a $987,000 jury verdict in the 349th Judicial District Court in Jeff Davis County, Texas.
In 2009, a drunk driver with a BAC of .295 crossed the center line while driving near Fort Davis, Texas and entered into a head-on collision with a 35-year-old father towing four horses. The father survived but was hospitalized for four days and had to undergo knee surgery. The drunk driver was killed in the crash. One of the horses died and the other three had to be retired due to their injuries.
After a two day trial, the 12 person jury composed of 6 men and 6 women handed down a unanimous verdict of $987,000, including $350,000 in punitive damages. Deliberation over the punitive verdict only lasted 15 minutes.
For a community the size of Fort Davis, the jury’s decision was a huge statement. They made it loud and clear that the people of Fort Davis will not tolerate drunk driving in Jeff Davis County.
Here at the Kyle Law Firm we’re extremely proud that we could be a part of this decision and are very happy for the victim and his family. The father will use the awarded amount to cover any future knee surgeries and replace the horses that he was towing at the time of the accident.
