Murder Vs. Manslaughter In Texas

While both murder and manslaughter involve the unlawful killing of another human being, a conviction of murder can bring vastly more severe penalties than a manslaughter conviction in the state of Texas. To be charged with murder, a person must have knowingly and willingly caused the death of another person. This is known as “malice aforethought,” or the premeditated and conscious act of taking a life. On the other hand, manslaughter is the act of recklessly causing the death of another person, as in an auto accident or other mishap.

A conviction of murder can carry the following penalties:

  • A first-degree felony criminal record
  • Anywhere from five to 99 years in prison
  • Up to $10,000 in fines

Penalties for manslaughter can include:

  • A second-degree felony criminal record
  • Anywhere from two to 20 years in prison
  • Up to $10,000 in fines

A charge of murder may sometimes be escalated to capital murder under a wide range of aggravating circumstances such as if the victim was a police officer, firefighter or a child under six years of age. Capital murder is an offense punishable by death in Texas.

Regardless of the circumstances, any accusation of homicide is extremely serious and requires the skills of a knowledgeable attorney to be successfully defended against. Our lawyers can review the facts surrounding your case and craft a custom-tailored strategy on your behalf that exploits weaknesses in the prosecution’s case.
